1. DEFINITIONS
“Company” means Gigsavvy Ltd and its employees, contractors, and agents.
“Client” means the individual or organization purchasing training services.
“Participant” means any individual attending or accessing training services.
“Training Services” includes on-site training, online live training, and e-learning platform courses.
“Materials” means all training content, resources, documentation, certification and intellectual property provided.
“Platform” means the Company’s e-learning system and associated technology.
2. SCOPE OF SERVICES
2.1 Training Delivery Methods
The Company provides training through:
- On-site Training: Delivered at Client’s premises or designated venues
- Online Live Training: Virtual instructor-led sessions via video conferencing
- E-learning Platform: Self-paced courses accessed through our learning management system
2.2 Service Inclusions
- Course content as specified in the course description
- Instructor services (where applicable)
- Training materials and resources
- Certificates of completion (where applicable)
- Technical support for platform access
- Post-training support as specified in individual course agreements
3. BOOKING AND REGISTRATION
3.1 Course Booking
- Bookings must be made through official Company channels
- All bookings subject to availability and minimum participant numbers
- Course schedules may be subject to change with reasonable notice
- Group bookings require signed training agreement
3.2 Registration Process
- Complete registration required before course access
- Accurate participant information must be provided
- Corporate clients responsible for managing participant registrations
- Individual participants must register using their own details
3.3 Course Prerequisites
- Participants must meet stated course prerequisites
- Company reserves the right to refuse participation if prerequisites not met
- Prerequisite verification may be required before course commencement
4. PAYMENT TERMS
4.1 Pricing and Fees
- All prices quoted in GBP [£] unless otherwise stated
- Prices subject to change with 30 days’ notice
- Additional fees may apply for customisation or special requirements
- Group discounts available as per published rates or private agreement
4.2 Payment Schedule
- Individual Courses: Full payment due at time of booking
- Corporate Training: 50% deposit required, balance due 14 days before delivery
- Annual Licenses: Payment due upon contract signing
- Payment Terms: Net 30 days unless otherwise agreed
4.3 Late Payment
- Interest charges of 1.5% per month apply to overdue amounts
- Training Services including Materials may be suspended for non-payment
- Collection costs recoverable from Client
5. CANCELLATION AND REFUND POLICY
5.1 Cancellation by Client
On-site and Online Live Training:
- 21+ days before course: Full refund minus 10% administration fee
- 14-20 days before course: 50% refund
- 7-13 days before course: 25% refund
- Less than 7 days: No refund
E-learning Courses:
- Before platform access: Full refund minus 10% administration fee
- After platform access commenced: No refund
- Technical issues preventing access: Full refund available
5.2 Cancellation by Company
- Full refund provided for Company-initiated cancellations
- Alternative dates offered where possible
- Company not liable for consequential costs (travel, accommodation, etc.)
5.3 No-Show Policy
- Participants who fail to attend without notice forfeit all fees
- Rescheduling available subject to availability and additional fees
6. ON-SITE TRAINING SPECIFIC TERMS
6.1 Venue Requirements
- Client responsible for providing suitable training venue
- Venue must meet health and safety requirements
- Required equipment and facilities as specified in course requirements
- Minimum and maximum participant numbers apply
6.2 Travel and Accommodation
- Client responsible for all trainer travel and accommodation costs where agreed
- Agreed Expenses charged at cost plus 10% administration fee
- Cancellation charges apply if training cancelled within 48 hours
6.3 Access and Security
- Client to provide necessary site access and security clearances
- Advance notice required for restricted or secure locations
- Company personnel subject to Client’s site safety requirements
7. ONLINE TRAINING SPECIFIC TERMS
7.1 Technical Requirements
- Participants responsible for ensuring adequate internet connection
- Required software and hardware specifications provided in advance
- Technical support available during scheduled training hours
- Backup communication methods provided
7.2 Platform Access
- Access credentials provided prior to course commencement
- Participants responsible for maintaining credential security
- Sharing of access credentials prohibited
- Platform available 30 minutes before scheduled start time
7.3 Recording and Attendance
- Sessions may be recorded for quality and training purposes
- Participants consent to recording by attending
- Attendance monitoring may be implemented
- Minimum attendance requirements for certification
7.4 IOSH Assessment
The Company will use robust assessment procedures and controls that meet the requirements of the IOSH terms and conditions. This includes making sure that:
- the assessment is taken in a timely way to avoid learners being disadvantaged by a long wait between the end of the course and the start of the assessment process
- only learners who have attended all course modules can sit the assessment
- the identity of the learner is verified. Where an assessment centre is not the learner’s own workplace, formal identification should be seen (eg showing a passport or verifiable ID) by the Company
- the assessment is carried out in exam conditions with an invigilator present (virtual or physical)
- the assessment centre is free from malpractice, ie the invigilator should not have a vested interest in the learner passing the assessment and suitable checks should be carried out to ensure the exam room does not contain information that would be construed as malpractice
- the assessment paper given must be the relevant IOSH-approved paper for the course attended
- assessment papers are not distributed to or seen by learners prior to the start of the assessment, or kept by them after it
- any learner failing the assessment can re-sit, using an alternative paper in accordance with the IOSH administration of the assessment procedures for the relevant IOSH course
For online assessments, additional rules are applicable:
- any online assessment process must have been tested and approved by the IOSH tailored course approval team before use
- the training provider must replicate classroom-based exam conditions, ie learners must not have access to course materials or notes during the assessment
- the learner must not be able to access the internet during the assessment, where necessary by means of browser lockdown applied by the Company
- the Company will obtain and keep written/typed/emailed statements from all learners that they will complete the assessment in closed-book conditions and will not refer to their workbooks, the internet, or any other sources
- where learners are in a range of locations, assessment papers must be emailed to them immediately prior to the start of the assessment. Learners must be able to type their responses on these assessment papers, and email them back to the Company at the end of the timed assessment
8. E-LEARNING PLATFORM TERMS
8.1 Platform Access
- Access granted upon payment confirmation
- Individual user accounts required – sharing prohibited
- Access duration as specified in course description
- Platform available 24/7 with scheduled maintenance windows
8.2 User Responsibilities
- Maintain confidentiality of login credentials
- Use platform in accordance with acceptable use policy
- Report technical issues promptly
- Complete courses within specified timeframes
8.3 Content Access
- Download restrictions may apply to course materials
- Offline access available for selected content only
- Content updates provided at Company’s discretion
- Archive access subject to separate agreement
9. INTELLECTUAL PROPERTY
9.1 Ownership
- All training materials remain Company’s intellectual property
- Participants granted limited license for personal/internal use only
- No reproduction, distribution, or commercial use without written consent
- Third-party content subject to separate licensing terms
9.2 Confidentiality
- Training content considered confidential information
- Participants bound by confidentiality obligations
- Non-disclosure agreements may be required
- Breach of confidentiality subject to legal action
9.3 Client Content
- Client retains ownership of proprietary information shared
- Company granted license to use Client content for training delivery
- Confidentiality maintained regarding Client-specific information
10. HEALTH AND SAFETY MANAGEMENT SYSTEM
10.1 System Overview
The Company provides an online health, safety and security management system (“HSSMS”) including:
- Risk assessment tools and templates
- Health, safety, and security policy libraries
- Digital incident reporting system
- Safety briefing and communication tools
- Compliance monitoring and reporting features
- Document management and version control
10.2 Subscription Terms
- Access granted upon subscription payment and account setup
- Subscription periods as specified in individual agreements
- Auto-renewal unless cancelled with 30 days’ notice
- User licenses non-transferable between organisations
- Additional user licenses available at published or previously agreed rates
10.3 System Access and Security
- Multi-level user access controls available
- Administrator accounts for client management of users
- Secure login requirements including password complexity
- Session timeout for security compliance
- Audit trails maintained for all system activities
- Data encryption in transit and at rest
10.4 Risk Assessment Tools
- Templates provided for guidance only
- Client responsible for customising assessments to specific circumstances
- Regular review and updates of risk assessments required
- Professional judgment must be applied to all assessments
- Company not liable for adequacy of Client-generated risk assessments
10.5 Policy Libraries and Templates
- Policies provided as starting templates only
- Must be customised to comply with applicable laws and regulations
- Client responsible for ensuring policies reflect current legislation
- Regular policy reviews and updates Client’s responsibility
- Legal review of policies recommended before implementation
10.6 Incident Reporting System
- Secure reporting and investigation workflow tools
- Confidential handling of sensitive incident information
- Automatic notification and escalation features
- Data retention in accordance with legal requirements
- Integration with external reporting systems where required
10.7 Compliance and Regulatory Requirements
- System designed to support compliance efforts
- Client remains solely responsible for regulatory compliance
- Regular system updates to reflect changing regulations
- Any compliance monitoring tools are provided for guidance only
- Professional compliance advice recommended for complex requirements
10.8 Data Ownership and Portability
- Client retains ownership of all data entered into system
- Data export facilities available
- Data portability upon reasonable request
- Backup and recovery procedures in place
- Data deletion upon contract termination (with appropriate notice period)
10.9 System Limitations and Disclaimers
- System provides tools and templates – not professional advice
- Client responsible for ensuring suitability for specific circumstances
- No guarantee of regulatory compliance through system use alone
- Professional consultation recommended for complex safety issues
- System cannot replace competent safety management expertise
10.10 Performance and Availability
- 99.5% uptime target (excluding scheduled maintenance)
- Scheduled maintenance windows communicated in advance
- Emergency support available for critical system issues
- Regular system backups and disaster recovery procedures
- Performance monitoring and optimization ongoing
11. PERSONNEL AND BUSINESS DIRECTORY
11.1 Directory Overview
The Company provides a directory platform (“Directory”) that allows:
- Personnel (workers, self-employed, volunteers) to create profiles and seek opportunities
- Businesses/Organizations to post requirements and search for personnel
- Networking between platform users who have completed Company training programs
- Access is granted automatically upon completion of qualifying training courses
11.2 Company Role and Limitations
- NOT AN EMPLOYMENT AGENCY: Company is not an employment agency, recruitment agency, or broker
- PLATFORM PROVIDER ONLY: Company provides technology platform for user connections
- NO EMPLOYMENT RELATIONSHIP: No employment relationship created between Company and Directory users
- NO GUARANTEES: Company makes no guarantees about employment outcomes or user suitability
- NO ENDORSEMENT: Listing on Directory does not constitute Company endorsement of any user
11.3 User Eligibility and Access
- Access granted upon completion of Company training programs
- Separate registration may be required for Directory use
- Users must be legally eligible to work in their stated locations
- Business users must be legitimate organisations
- Company reserves right to verify credentials and remove inappropriate profiles
11.4 User Responsibilities – Personnel
- Provide accurate, current, and truthful information
- Maintain professional conduct in all platform interactions
- Responsible for own employment eligibility and work authorisation
- Must disclose any relevant criminal convictions or professional restrictions
- Comply with all applicable employment and safety regulations
- Update profile information promptly when circumstances change
11.5 User Responsibilities – Businesses
- Provide accurate organisation information and legitimate opportunities
- Comply with all applicable employment laws and regulations
- Conduct own due diligence on potential personnel
- Responsible for own recruitment processes and employment decisions
- Not discriminate on protected characteristics
- Verify work authorisation and conduct appropriate background checks
- Endeavor to support and employ underrepresented groups in society
11.6 Profile Content and Verification
- Users responsible for accuracy of all profile information
- Company does not verify credentials, references, or background information
- Company may remove profiles containing false or inappropriate information
- Professional qualifications and certifications remain user’s responsibility to maintain
- Training completion status updated automatically from Company records
11.7 Communication and Contact
- Platform provides communication tools for initial contact only
- All employment negotiations outside Company’s platform and responsibility
- Users must not share personal contact information inappropriately
- Company may monitor communications for platform safety and compliance
- Inappropriate communications may result in account suspension
11.8 Prohibited Activities
- Personnel: False credentials, misrepresentation of qualifications, inappropriate contact
- Businesses: Fraudulent opportunities, illegal employment practices, discrimination
- Both: Harassment, spam, commercial solicitation unrelated to employment
- All Users: Attempting to bypass platform for fee avoidance, data harvesting
11.9 Employment Process Disclaimer
- All employment decisions made independently by businesses
- Company not involved in interview, selection, or hiring processes
- Employment terms and conditions determined solely between parties
- Company not responsible for employment disputes or workplace issues
- No liability for employment outcomes, wages, or working conditions
11.10 Background Checks and Due Diligence
- Company does not conduct background checks or verify credentials
- Businesses responsible for own due diligence processes
- Personnel responsible for providing accurate information for checks
- Company may provide training completion records only
- Professional references and employment history verification user’s responsibility
11.11 Data Protection – Directory Specific
- Directory profiles contain personal and professional information
- Users consent to profile information being visible to other users
- Business contact information may be shared with personnel
- Data retention continues while Directory access maintained
- Profile deletion available upon request (subject to legal retention requirements)
11.12 Fees and Payments – Directory
- Directory access included with qualifying training programs
- No additional fees for basic directory functionality
- Premium features may be available at additional cost
- No commission or fees charged on employment arrangements
- Company not involved in any financial transactions between users
11.13 Liability Limitations – Directory Specific
- Company not liable for employment outcomes or workplace incidents
- No responsibility for user conduct outside platform
- Not liable for false information provided by users
- No liability for employment law violations by users
- Users indemnify Company against claims arising from Directory use
11.14 Termination and Suspension
- Company may suspend or terminate Directory access for policy violations
- Training completion requirement maintained for continued access
- Account termination does not affect completed employment relationships
- Data retention according to legal requirements after termination
- Appeal process available for account suspensions
12. CERTIFICATION AND ASSESSMENT
12.1 Certification Requirements
- Attendance and/or assessment completion required for certification
- Minimum passing grades apply where assessments used
- Certificates issued digitally unless otherwise requested and agreed with company
- Certification valid for period specified in course description
12.2 Assessment Policy
- Assessments must be completed individually
- Cheating or plagiarism results in disqualification
- Re-assessment opportunities may be subject to additional fees unless stated otherwise
- Assessment results confidential to participant and Client
12.3 Continuing Education
- Some certifications require ongoing professional development
- Renewal requirements specified in certification documentation
- Company may provide continuing education opportunities
13. LIABILITY AND INSURANCE
13.1 Limitation of Liability
- Company liability limited to fees paid for specific training course or system subscription
- No liability for indirect, consequential, or punitive damages
- Participant injury covered by Company’s public liability insurance
- Force majeure events exclude Company from liability
- H&S System Specific: No liability for safety incidents arising from Client’s use or misuse of system tools, templates, or recommendations
- Company not liable for regulatory non-compliance despite system use
- Directory Specific: No liability for employment outcomes, workplace incidents, or disputes between Directory users
13.2 Insurance Coverage
- Company maintains appropriate professional indemnity insurance
- Public liability coverage for on-site training delivery
- Participants responsible for their own insurance coverage
- Insurance certificates available upon request
13.3 Indemnification
- Clients indemnify Company against third-party claims arising from training delivery
- Participants liable for damage to Company or Client property caused by negligence
- Misuse of training content or intellectual property subject to legal action
- Directory users indemnify Company against claims arising from employment relationships or workplace incidents
- H&S System users indemnify Company against claims arising from safety incidents related to system use
14. DATA PROTECTION AND PRIVACY
14.1 Data Collection and Processing
- Personal data collected and processed in accordance with our Privacy Policy
- Full details of data handling practices available in our Privacy Policy
- Participants and clients consent to data processing as outlined in our Privacy Policy
- Data processed in accordance with UK GDPR and Data Protection Act 2018
- Incident data may include sensitive personal information
- H&S System: Special categories of data (health, safety incidents) processed under legal obligation and legitimate interests
- Directory: Professional profiles shared with other users by consent
14.2 Data Security
- Appropriate technical and organizational security measures implemented

14.3 Participant Rights
